Terms of Service

FyXe is run by Richard van den Bogaard, the Netherlands. By using the app you agree to these terms. If you don't, please don't use it.

1. Who can use FyXe

You need to be at least 16 years old. One person, one account. You are responsible for what happens under your account, and for keeping access to your email address secure โ€” that is how signing in works.

2. What you post

Your sessions, notes, comments and profile stay yours. You keep every right you had in them. You give us permission to store and display that content to the people you chose to share it with โ€” that's what running the app requires, and nothing more.

3. Reporting content

Anyone โ€” user or not โ€” can report content they believe is illegal or breaks these terms. Report it in the app using the report option on a session, comment or profile, or email report@vandenbogaard.info.

Tell us what you found, where it is, and why you think it is a problem.

What happens next, and by when:

  1. We confirm we received your report within 2 working days.
  2. Clear-cut cases are acted on straight away. If an image is obviously illegal or plainly does not belong here, we make it invisible to others first and assess it afterwards. Taking something down is always allowed to be faster than the deadlines below.
  3. We decide within 7 calendar days of your report. We assess the content against these terms. The outcome is that we remove it, keep it hidden, or leave it up. We may also restrict or suspend the account behind it.
  4. We tell you what we decided and why โ€” and we tell the person who posted the content the same thing, with the same reason. If your content is removed, you always hear why.
  5. You can object. Disagree with the decision, whether you reported the content or posted it? Reply to that message and we will reconsider. You can also take the matter to a court, or to an out-of-court dispute settlement body.

We keep a record of every report, the decision, and the dates โ€” currently in our mailbox at the addresses below. That is how we can show these deadlines are met.

These are the deadlines we commit to. We would rather name a period we can actually meet than a shorter one we cannot: FyXe is run by one person alongside a day job, and a promise that is structurally missed is worth less than an honest one.

Reporting in bad faith โ€” repeatedly filing reports you know to be unfounded โ€” can itself lead to measures against your account.

4. Blocking

You can block another user. After that, they can't see your content and you can't see theirs. Sessions you both took part in stay in both histories โ€” they happened, and one person can't erase them from the other's record โ€” but you won't see each other's names linked to a profile any more.

6. Availability

FyXe is free while it is in development. We do our best to keep it running, but we can't promise it will always be available or free of faults, and we may change or discontinue features. If we ever shut the service down, we will give you reasonable notice and a chance to export your data.

7. Liability

The app is provided as it is. To the extent the law allows, we are not liable for indirect or consequential damage, for data loss beyond what our own backups can restore, or for what other users post. Nothing here limits liability for intent or gross negligence, or any other liability that cannot be excluded under Dutch law.

Game data comes from BoardGameGeek and is used under their terms; we don't guarantee it is accurate or complete.

8. Ending it

You can delete your account at any time from Settings, which is immediate and permanent. We may suspend or terminate an account that breaks these terms, and we will say why unless the law prevents us.

9. Changes

We may update these terms. If a change matters, we will tell you in the app before it takes effect. Continuing to use FyXe after that means you accept the new version.

10. Applicable law

Dutch law applies. Disputes go to the competent court in the Netherlands, unless mandatory consumer rules give you the right to a different court.
